1. Who these terms apply to

These terms govern your use of the BK Properties platform. They apply to managers (letting agents who administer properties), owners (people whose properties are managed) and tenants (people who apply for or rent a unit). By creating an account or using the platform you agree to these terms; if you do not agree, do not use the platform.

2. The service

BK Properties is software that lets managers list properties, receive and screen applications, manage tenants and leases, record payments, and handle maintenance. It is a tool used by the manager or owner responsible for a property; it does not itself let property, hold deposits, or act as an estate agent or financial institution.

3. Accounts and access

• You must give accurate account details and keep them up to date.
• You are responsible for keeping your sign-in credentials confidential and for activity under your account.
• Access is role-based: you may only use the features and see the data your role allows. You must not attempt to reach data belonging to another user.
• Tell us promptly if you believe your account has been used without your permission.

4. Acceptable use

You agree not to:

• upload unlawful, fraudulent or misleading content, or documents you have no right to share;
• use the platform to harass, discriminate against, or infringe the rights of any person;
• attempt to breach security, probe for vulnerabilities, or disrupt the service;
• copy, scrape or resell the platform or its data other than as permitted by these terms.

5. Responsibilities of each party

Managers and owners

Managers and owners are the responsible parties for the personal information they process through the platform and must handle it lawfully, including under POPIA. They are responsible for the accuracy of listings, charges and lease terms they enter, and for the lawful basis of the tenant and applicant data they upload.

Tenants and applicants

Tenants and applicants must provide honest and accurate information, and may upload only documents that relate to them and that they are entitled to share. Submitting an application or maintenance request does not create any obligation on an owner or manager to accept it.

6. Payments and statements

Rent charges, receipts and owner statements produced by the platform are records of amounts entered or reconciled by the manager. They are provided for convenience and do not replace the underlying lease or any invoice, receipt or tax record the responsible party is required to issue or keep.

7. Personal information

Our handling of personal information is described in the privacy notice, which forms part of these terms. Managers and owners remain the responsible parties for the personal information they process; we act as their operator.

8. Availability and changes

We aim to keep the platform available and secure, but it is provided on an "as is" and "as available" basis, without warranties of uninterrupted or error-free operation. We may update, add or remove features, and may change these terms; where a change is material we will make the updated terms available here with a new "last updated" date.

9. Liability

To the extent permitted by law, BK Properties is not liable for indirect or consequential loss, or for loss arising from data or decisions entered by a manager, owner or tenant. Nothing in these terms limits any liability that cannot be limited under South African law, including under the Consumer Protection Act where it applies.

10. Suspension and termination

We may suspend or end access to an account that breaches these terms or puts the security of the platform or other users at risk. You may stop using the platform at any time; on termination, records we are required to keep are retained and then destroyed as set out in the privacy notice.

11. Governing law and contact
